1. The Grinch that stole email.
Email held the promise of a new era in communications. Almost free. What has happened instead? Spammers have hijacked the system. They use every trick in the book, from misleading subject lines to deliberately misspelled words. All to defeat email filters and sell phoney get rich quick schemes, drugs and sex aids. The result of this is that often your genuine, non-spam email will get swept into the trash box as well. This is known as a false-positive. Our problem in this industry is even worse, because the word "mortgage" is scanned for by these email filters and will often put your message in the trash.

Enter the Federal government. A new law effective January 1, 2004 regulates commercial email and makes many of these practices illegal. Has the law stopped the flood of junk into your mailbox? Not one little bit.

What it does do is make legitimate commercial emailers follow a set of rules. It applies to ALL commercial email, solicited and unsolicited.
In future your commercial email must contain:
* a legitimate return email address and postal address.
* a clear and conspicuous notice that the recipient may opt-out of receiving commercial email from you.
* a mechanism that can be used or email address (active for at least 30 days) to enable the person to opt-out of receiving messages from you.
The rquest must of course be honored.
* a clear and conspicuous notice that the message is an advertisement or solicitation. And clear notice in the subject line if messages contain pornographic or sexual content.

There are exceptions:

Persons with whom one has a prior relationship are NOT excluded. But transactional messages ARE excluded.

These include messages to:
* facilitate, complete or confirm a commercial transaction that the customer has agreed to enter into with the sender
* provide warranty and product recall information
* information about a subscription, account,loan etc.Or similar ongoing service provided by you.
* information directly related to an an employment relationship or employee benefit which the employee is currently involved in
* to deliver goods or services relating to a transaction entered into by the customer.

2. New zero down program being introduced in Congress by Rep. Pat Tiberi (R-OH).
Congressional approval is needed before any zero downpayment mortgages are released.
"This legislation will make the dream of home ownership come true for families who can make monthly payments, but have been denied a mortgage simply because they don’t have money for down payments," said Tiberi, a member of the House Housing Subcommittee. "Minority families in particular are burdened by high down payment requirements."

It will also create a whole flood of foreclosures in our opinion. Time and again it has been shown, people with no "skin" in the deal are more likely to jump ship if the going gets tough.

3. IRS forms 1098, 1096 and more. Note that forms 1098 must be provided to the mortgage payers by January 31 and to the IRS by February 28.
